Analysis says earned settlement protection for existing visa holders is still undecided

25 Oct 2026

If you are already building time towards settlement (ILR), do not assume that you will be protected from the earned settlement changes. A legal analysis published on 22 October 2026 says two recent parliamentary answers leave this question open.

The analysis is by Advokato. It looks at a written answer dated 21 October 2026 and one dated 19 October 2026. According to the article, the 21 October answer says the government is considering more than 200,000 responses to its earned settlement consultation. The question was about people who already have time on previous routes. The article says the answer does not set a final rule for them. The 19 October answer says the government intends to make a statement to Parliament before laying the relevant Immigration Rules changes.

The article says neither answer shows that all current visa holders are protected, or that everyone's settlement clock will restart. It calls the answers "evidence of the reform process, not a substitute for the eventual legal text." This is one firm's reading of the answers. We could not open the parliamentary pages ourselves, so we have not checked the wording of the answers directly.

What can you do? The article suggests you check the current rules for your own route. It also suggests you keep a dated record of your immigration history, including grants, receipts and travel records. It warns that applying urgently does not automatically secure treatment under the old rules, because that depends on future commencement and transitional provisions. It also says an employer's assurance or a social media claim is not a sound basis for action. Its legal check date is 22 October 2026, so later changes are not covered.
