Article 8 reform factsheet published for Immigration and Asylum Bill
10 Oct 2026
If you rely on family life or private life in the UK as part of an application or appeal, a new Home Office factsheet may matter to you. It was published on 8 October 2026 and covers Article 8 reform in the Immigration and Asylum Bill. These are plans. The factsheet does not say the changes are law.
The factsheet says the Bill would do three things. It would strengthen the public interest test so that immigration control and economic prosperity get proper weight. It would define family life in law, limiting Article 8 protections to immediate family members rather than extended family. It would also require UK-based sponsors for overseas family life claims.
The government says the aim is to "restore public confidence and ensure that the UK application of rights is in line with the Strasbourg court". A separate overarching factsheet says the Bill will "define the application of Article 8".
Nothing changes for you today. If your case depends on family or private life, keep an eye on the Bill's progress and on GOV.UK. Take advice from a regulated adviser if you are unsure how it could affect you.
