New right-to-work and right-to-rent codes apply from October 2026
01 Jul 2026
If you hold a UK visa and have an eVisa, your employer and your landlord will both need to follow updated rules when checking your immigration status from 1 October 2026.
The government published new versions of two codes of practice on 30 June 2026. The right-to-work code, which applies to employers, now reflects "digital right to work checks, including the online service and eVisas." It also sets out equal treatment requirements and safeguards for anyone who cannot access digital services. The right-to-rent code, which applies to landlords across England, was updated on the same date and comes into force on the same date.
The practical change for most visa holders is straightforward. From 1 October 2026, employers and landlords are expected to use the Home Office online service to check eVisa status, rather than relying on physical documents. If your employer or landlord is unsure how to check your status, they can use the "Check if someone can work in the UK" tool on GOV.UK, or the Employer Checking Service for anyone with an outstanding Home Office application.
If you are starting a new job or signing a new tenancy on or after 1 October 2026, you may want to mention the updated codes if your employer or landlord is unfamiliar with eVisa checks. The full codes are publicly available via the links below.
